General terms of sale

1. Purpose

These general terms of sale apply to all orders placed on the website wicket.fr by consumers, that is, individuals buying for non-professional purposes. Purchases made in our shops, including special orders, are not covered.

They can be consulted at any time on the website and must be accepted before any order is placed. The applicable version is the one in force on the day of the order.

2. The seller

3. The items

Our items are described and photographed with the greatest care; slight differences in colour may remain depending on your screen. Offers are valid while stocks last. Should an item you ordered turn out to be unavailable, we would let you know without delay and refund you in full.

4. Prices

Prices are shown in euros, including all taxes, excluding delivery costs. Delivery costs are shown before the order is confirmed; delivery is complimentary for purchases of €500 or more in France and the European Union. The price charged is the one displayed at the time of the order.

5. Ordering

To order, add the items to your bag, enter your details and the delivery or collection method, then pay online. Before paying, you can check the details of your order and its total price, and correct any errors. The contract is concluded when the payment is confirmed.

We confirm your order by email. For any order of €120 or more, we keep the contract for ten years and give you access to it on request (articles L. 213-1 and D. 213-1 of the French Consumer Code).

6. Payment

Payment is made online when you order, by bank card (Visa, Mastercard) or Apple Pay, through Shopify’s secure payment service. Your bank details are encrypted and are never passed on to us. Your account is debited when the order is confirmed.

7. Delivery and in-store collection

We deliver to France and to the European Union countries offered when you order. Your order is dispatched within 1 to 3 working days of its confirmation, with a tracking number. The delivery time is shown before the order is confirmed; failing that, delivery takes place no later than thirty days after the order.

Click & Collect: you can collect your order from one of our three Paris shops (Grenelle, Malesherbes, Courcelles). It is usually ready within 2 to 4 days; we let you know as soon as it is waiting for you.

Items travel at our risk: you become responsible for them when you, or the person you have designated, take physical possession of them. If delivery is late, you may cancel the order under the conditions set out in articles L. 216-6 et seq. of the French Consumer Code. If a parcel is damaged, we advise you to report it to the carrier and to let us know promptly.

8. Right of withdrawal

You have fourteen working days (Monday to Friday, excluding public holidays) from receipt of your order, or its collection in store, to withdraw from your purchase without giving any reason. This period is longer than the legal period of fourteen days.

To exercise this right, inform us of your decision by a clear statement, sent by email to wicketshop@wicket.fr or by post to WICKET SARL, 61 boulevard Malesherbes, 75008 Paris, France. You may use the withdrawal form below, but you do not have to.

Then send the items back to us, complete and in their original condition, no later than fourteen days after informing us of your decision. Return costs are at your expense. You remain liable for any diminished value of the items resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

We will refund all sums paid, including the initial delivery costs (on the basis of the standard delivery rate), no later than fourteen days after being informed of your decision, using the same means of payment. We may withhold the refund until we have received the items or until you have supplied proof of having sent them back. If you prefer, we can make an exchange, subject to availability.

In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to items made to your specifications or clearly personalised.

9. Legal guarantees

All our items are covered by the legal guarantee of conformity and the guarantee against hidden defects. To make a claim, contact WICKET SARL, 61 boulevard Malesherbes, 75008 Paris, France · +33 1 45 49 00 91 · wicketshop@wicket.fr. If the item has to be sent back to us, return costs are borne by us.

Box required by French law (Decree no. 2022-946), reproduced in translation:

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to supply all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

10. Complaints

For any complaint, write to us at wicketshop@wicket.fr: we will reply as soon as possible.

11. Personal data

The data collected when you order is processed in accordance with our legal notice and our privacy policy.

12. Applicable law and disputes

These terms are governed by French law. In the event of a dispute, and failing an amicable solution, you may refer the matter, at your choice, to the court of the place where you lived at the time of the order or of the delivery, or to any other court having jurisdiction under the ordinary rules.
